Applies to "establishment" and 'employment' from the date this Act came into force to such employment and establishments to men and women workers. Does not apply when special treatment is given to women on account of any law, in respect of child birth, marriage death and retirement.
2(a) (i) (ii) Appropriate Government Central & State. 2(c) 'employer' definition in the Payment of Gratuity Act 1972 applies. 2(g) Remuneration means basic wage, additional emoluments whatsoever payable in cash or kind as per terms of contract. 2(h) Same work of a similar nature-means work in which skill, effort and responsibility are same when performed under similar working conditions by man and woman and even if that is some difference, it is not of practical importance. 2(i) 'worker' - means workers of establishment to which this Act applies.
Employer to pay equal remuneration to men and women workers for same work of a similar nature.
No discrimination to be made while recruiting men and women workers for same work of a similar nature except if prohibited/restricted by law for cases of reservation or otherwise.
Authorities to decide claims and complaints. An appeal lie to Appellate Authority within 30 days if aggrieved.
Duty of Employers to maintain registers in Form 'D'.
Appointment and powers.
Penalties - (1) For failure to maintain Registers/musters roll and refusal to tender information, preventing to give evidence etc. Imprisonment - one month for both. or fine 10,000/- maximum for both. (2) a) to d) Contravenes the provision in recruitment, remuneration, by discrimination between men and women and violates the directions issued by Appropriate Government consequent upon Sec. 6(5) - Fine maximum 20,000 or imprisonment maximum 3 months for both.
