To child & Adolescent No child shall be employed. Adolescent is not permitted to work in Hazardous occupations. Excludes Helping family & Family enterprise if not hazardous, works as an artist in an audio-visual entertainment industry- advertisement, films, television serials & the like, sports except circus.
(i) 'Appropriate Government' In relation to establishment under the control of Central Government or Rly. Admn. or a major port or a mine or oilfield - the Central Government and for others State Government. (ii) 'Adolescents' - Completed 14 years of age but not completed 18 years. (iii) 'Child' means who has not completed his fourteenth year of age or that specified in the Right to children to Free and Compulsory Education Act, 2009 whichever is more. (iv) 'Establishment' - Includes - shop, commercial establishment, workshop, farm, residential hotel, restaurant, eating house, theatre or other place of public amusement or entertainment. (v) 'Family' in relation to occupier, the individual, the wife or husband, their children, brother or sister of such individual.
Regulation of conditions of work of Adolescents Prohibits employment in the occupations ог processes. carried in mines, inflammable substances or explosives or hazardous process.
Hours and period of work of adolescents (1) cannot be more than that prescribed to such establishment or class of establishments. (2) requires rest of 1 hour after 3 hour of work. (3) spread over not more than 6 hours including rest. (4) work prohibited between 7 p.m. to 8 a.m. (5) O.T. is not permitted. (6) Not permitted to work in two establishments on same day.
Weekly Holidays Adolescents are entitled one whole day in a week - to be specified in Notice Board
Notice to Inspector – within 30 days of adolescents employment other than the family members.
Disputes as to age of Adolescents - to be referred to prescribed medical authority.
Maintenance of Register of Adolescents Occupier is to maintain.
Notice - Abstract of S. 3A & 14 to be displayed.
Penalties For violation of Sec. 3 & 3A imprisonment for a term not less than 6 months but extend to 2 years or with fine 20,000/- to ₹ 50,000/- or both. For repeated offence once convicted- Imprisonment for not less than 1 year or extendable up to 3 years. For parents - Fine up to₹10,000/- if once convicted
